Our Approach

The Phase II question

A Phase II is an instrument, not a reflex. How a consultant answers this question tells you more about them than any qualifications package.

The industry default is to resolve every REC with a sampling recommendation. It's defensible, it's easy, and it's where the larger fees are. It's also frequently not what the project needs.

Before we recommend sampling, we ask what else could resolve the condition. Working alongside our clients, engineers, and land teams, we have resolved conditions by:

  • Adjusting the development footprint early, while the layout is still fluid, so a condition falls outside the project entirely
  • Excluding an area of concern from the lease or transaction boundary, documented defensibly, with safety and liability properly addressed
  • Right-sizing the investigation when sampling is warranted, so a targeted protocol answers the question instead of an open-ended program

There are two unambiguously good reasons to put a drill rig or a sampling crew on a solar site: a REC that genuinely cannot be resolved any other way, and establishing brownfield status when the federal credit adder is the objective and sampling is the point.

When sampling is the right tool, we say so without hesitation. When it isn't, we say that too.

DALLAS-FORT WORTH REGION SOLAR SITE

The REC that never needed a Phase II

Historical aerials and the site reconnaissance revealed that a neighboring property had been dumping hazardous materials onto a corner of the Subject Property for years, resulting in a significant recognized environmental condition. The affected corner sat near a wetland area already likely to constrain the layout.

Rather than recommending an investigation, we brought the finding to the design team while the site plan was still fluid. A modest layout adjustment and a revised lease boundary excluded the area from the project entirely, addressed head-on and documented defensibly, with safety and liability properly accounted for.

OUTCOME No Phase II required. Development objectives met, condition resolved above board, weeks saved on the diligence schedule.

TEXAS HILL COUNTRY SOLAR SITE

A dipping vat and a right-sized answer

A Phase I identified a historic cattle dipping vat, a classic REC carrying the potential for arsenic, heavy metals, and legacy pesticides. The reflex answer would have been a broad sampling program across the site.

Instead, we designed a limited Phase II protocol of surface and shallow subsurface sampling targeted precisely to the vat area, its operational footprint, and the downgradient flow path, built around how these features actually release and migrate contaminants.

OUTCOME Conclusively demonstrated the area was not impacted by arsenic, heavy metals, or pesticides. A targeted investigation at a fraction of the cost of a site-wide program.
